Tent Requirements for COVID Safety Fall 2020

To: Nassau County Fire Departments, Town / City / Village Building Departments, Business and   Property Owners   

 

General Information regarding tents, canopies, and membrane structures specific to NYS Executive Orders regarding their use for dining purposes.

 

All tents, canopies and membrane structure used for the purpose of outdoor dining as per the NYS Executive Orders shall be operated in compliance with NY Forward Dining Guidelines. 


If any such tent, canopy or membrane structure is operated for such purposes, and any two (2) side panels or enclosure of such tent is used for wind, weather protection or any other use, this would then require its use to conform indoor dining requirements set forth in the Forward NY guidelines . (50% occupancy limit) would then need to be maintained. All other requirements for such use would then need to be adhered to, such as exit signs, maintenance of aisleways, exit ways. Occupancy limits for such use shall be set by the local authority having jurisdiction in Nassau County which would be the Town of Hempstead, Town of North Hempstead, Town of Oyster Bay, or the village or city building department. The occupancy for such use shall be posted at all times.

The equipment involved shall be inspected on a case by case basis to determine the needs and requirements of each individual location. This letter of codes and requirements shall not be applied as a general approval or disapproval of any installation but shall be used as an instrument to determine conformance or non-conformance with the Fire Code of New York State and the Nassau County Fire Prevention Ordinance.  There may be more restrictive codes and regulations by other government agencies or local towns, villages, or cities.
