ENFORCEMENT OF LAWS, RULES AND REGULATIONS

The Nassau County Board of Health issues fines for violations of the New York Public Health Law, New York State Sanitary Code, Nassau County Public Health Ordinance, New York State Environmental Conservation Law (Petroleum Bulk Storage) and Nassau County Local Laws administered and enforced by the Nassau County Department of Health.

New York State Sanitary Code – Title 10 NYCRR Chapter 1 (Parts 1-24)

Generally, the Department of Health strives to achieve compliance through education. However, there are instances when a business, landlord, resident or other regulated entity fails to comply with rules and regulations set forth by State or Local law and when this occurs, the responsible party is served with charges and the case is heard by an Administrative Law Judge.

The Administrative Law Judge will then render a Decision which includes findings of fact and conclusions of law of the case, and will make recommendations for penalty to the Board of Health. The Board of Health determines the appropriateness of the penalty, as well as any other remedial measures required by the Respondent.

Food Service Establishment Closure List

Food Service Establishments that fail inspection may be required to close if violations cannot be immediately corrected and conditions pose an imminent Public Health Hazard. Some facilities voluntarily close until violations are corrected while others are ordered to close by the Department of Health. No facility is permitted to re-open until the Department has re-inspected and determined that violations have been corrected and all potential health hazards have been abated.
